The Therapeutic Goods Administration (TGA), Australia's primary health regulator, has led these changes to control who can buy vapes, where they can be sold, and what goes into them.

What the New Laws Mean

As of July 1, 2024, a new law—the Therapeutic Goods and Other Legislation Amendment (Vaping Reforms) Act 2024—came into effect. This law restricts the sale of all vaping products, with or without nicotine, to pharmacies only. This means that stores like tobacconists, vape shops, and convenience stores can no longer sell any type of vape.Starting October 1, 2024, people aged 18 and over can buy vapes with a nicotine concentration of 20 mg/mL or less from pharmacies without a prescription, depending on the rules in their state or territory. They must have a consultation with the pharmacist, who will help choose the right product and dosage. For young people under 18, or anyone needing higher nicotine levels, a prescription is still required.

Health Risks of Store-Bought Vapes

The main reason behind these new restrictions is the potential health risks of unregulated vapes, especially those bought from shops that don’t follow strict safety standards. Many vapes sold in non-pharmacy stores can contain unknown and potentially harmful chemicals. The TGA has raised concerns about these toxic substances, which may cause respiratory problems or nicotine poisoning, especially in children.Research has shown that some vapes contain chemicals not listed on their labels, raising further worries about what people are actually inhaling. Buying from regulated pharmacies ensures these products are tested for safety and quality, protecting users from potential unknown toxins.

Enforcing the New Rules

The TGA is working with state and local authorities to make sure these rules are followed. They’re conducting inspections, collaborating with other agencies, and encouraging the public to report any suspicious activity related to illegal vape sales. This includes cracking down on stores and online shops that may still be selling unapproved or mislabeled vapes.

Vaping and Quitting Smoking

Although some people see vaping as a way to quit smoking, the TGA does not recommend it as a first option. Research on the effectiveness of vapes for quitting smoking is still limited, and traditional methods, like nicotine patches or prescription medications, have more reliable results. People wanting to quit smoking should talk to their healthcare providers about the best options for them.

The Bigger Picture

Australia's new vaping laws reflect a strong focus on public health. By restricting where people can buy vapes and enforcing strict safety standards, the government aims to reduce the health risks associated with unregulated products and support people in finding safer ways to quit smoking.
